Terms of service
The agreement between your practice and Moonraker.AI, LLC for use of Moonraker ENGAGE.
Who these terms are with
Engage is provided by Moonraker.AI, LLC ("Moonraker", "we"). These terms apply when you create an account, start a trial, or use Engage. If your practice has signed a separate service agreement or a Business Associate Agreement with us, those signed documents control wherever they differ from this page.
What Engage is, and what it is not
Engage is software: an assistant that answers questions on your website, captures enquiries (a visitor's name, contact details, and what they say they are looking for), and books appointments into calendars you connect, including sending visitors their booking confirmations and self-service reschedule and cancel links by email. It is a tool your practice operates, not a clinician, and it does not provide medical advice, diagnosis, or treatment. Nothing in Engage creates a therapeutic relationship between Moonraker and any visitor.
Engage is not an emergency service. It surfaces crisis resources when a conversation warrants them, but it must never be relied on as a crisis response. Anyone in immediate danger should contact local emergency services; in the United States, call or text 988, the Suicide and Crisis Lifeline, or call 911.
Accounts
Accounts are for practices and their staff. You are responsible for the accuracy of the information you give us, for keeping sign-in credentials secure, and for what people do under your account. Tell us promptly if you believe an account has been compromised.
Your practice's responsibilities
You decide what the assistant knows and says on your behalf. That means you are responsible for the accuracy of the practice information, clinician details, policies, and pricing you enter, and for reviewing how the assistant represents them. You are responsible for telling your website visitors what you collect and why, and for meeting the legal obligations that apply to your practice.
Do not put protected health information into Engage until a Business Associate Agreement with us is in place. The product enforces this: while the agreement is unsigned, the public assistant is withheld and will not appear on your site.
Acceptable use
Do not use Engage to break the law, to mislead people about who they are talking to, to send unsolicited bulk messages, to infringe someone's rights, or to attack or probe the service or the people who use it. Do not attempt to extract other practices' data. We may suspend access to stop harm in progress.
Plans, trials, and billing
Paid plans and any free trial (currently 14 days) are described at the point of signup. Unless stated otherwise, subscriptions renew automatically for the same period until cancelled, and fees are billed in advance through our payment processor, Stripe. Cancelling stops the next renewal and keeps your access to the end of the period already paid for. We do not refund partial periods unless we say so in writing or the law requires it. We may change prices for a future period with reasonable notice.
Your data
The information your practice puts into Engage, and the conversations, enquiries, and appointments Engage handles for you, remain yours. You grant us the permission needed to operate the service for you: to store and process that data, and to let our infrastructure and communication providers (cloud hosting on Google Cloud, email delivery through Resend, payments through Stripe) do the same on our behalf. We do not sell it, and we do not use client data to train generalized artificial intelligence models.
How we handle information is described in ourprivacy notice, which includes what we do with data from a connected Google Calendar. Data handled under a Business Associate Agreement is governed by that agreement.
Services you connect
Engage can connect to services you already use, such as Google Calendar. Connecting one is your choice, it requires your approval through that provider, and you can disconnect it at any time in the dashboard. Those services have their own terms, and we are not responsible for how they behave or for changes they make.
Availability
We work to keep Engage available and will give notice of planned maintenance where we reasonably can. Unless your practice has a separate signed agreement that promises a specific uptime, Engage is provided without an uptime commitment.
Our intellectual property
Engage itself, including the software, its interfaces, and the Moonraker and Moonraker ENGAGE names and logos, belongs to us. These terms do not transfer any of that to you. You may use the service as it is offered; you may not copy, resell, reverse engineer, or build a competing product from it.
What we do not promise
Engage produces text automatically, and automated systems get things wrong. Answers can be incomplete or mistaken, and availability read from a connected calendar can be out of date. Keep a human in the loop for anything that matters clinically or commercially. Except where the law does not allow it, the service is provided as is, without warranties of any kind.
Limits on liability
To the extent the law allows, Moonraker is not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, goodwill, or data, and our total liability arising out of the service is limited to the fees your practice paid us in the twelve months before the claim arose. Nothing here limits liability that cannot be limited by law.
Suspension and ending the agreement
You may stop using Engage and cancel at any time. We may suspend or end access if these terms are breached, if payment fails and is not resolved, or if we must do so by law. When the agreement ends, we stop processing for you; on request we export your practice's data, identifying content in conversation and enquiry records is anonymized on our standard retention schedule, and where a Business Associate Agreement applies, its return-or-destruction terms control.
Changes
We may update these terms as the product changes. If a change materially affects you, we will give notice before it takes effect, and continuing to use Engage after that means you accept the updated terms.
Governing law and contact
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules, except where federal law controls. Questions go toengage@moonraker.ai.
